The following Terms of Service ("TOS") agreement is between Dragon Networks, Inc (hereinafter referred to as "Dragon") and anyone purchasing and/or using Dragon's Products and Services (hereinafter referred to as "Customer").

This agreement includes five sections: General and Business Policies, Backup Policy, Privacy Policy, Acceptable Use Policies ("AUP"), and the Service Level Agreement ("SLA") which are included herein by reference.

This agreement was last updated April 12, 2011, when paragraph 32 was added to the AUP Prohibited Use section on forwarding email. Prior to that, these terms were last updated April 22, 2009.

In consideration of the mutual covenants contained herein, Dragon and the Customer agree as follows:

Terms of Service
Backup Policy

Customer acknowledges and agrees that Customer's use of the Products and Services is at the Customer's sole risk. Dragon is not responsible for files and data residing on Customer's account.

Customer agrees to take full responsibility for files and data transferred to or created on Customer's account and to maintain all appropriate backups of files and data stored on Dragon's servers or network.

Customer further agrees that Dragon has the right to periodically prune old e-mail messages, access logs, or other data so as to maintain the reliability of the Products and Services for all customers by preventing the servers from running out of disk space, slowing down due to excessive numbers of files, or incurring any other problems related to the storage of these old e-mail messages, access logs, or other data files.

Customer agrees that Customer shall be solely responsible for maintaining backups of any such e-mail messages, access logs, or other data that Customer maintains on Dragon servers.

Dragon may, at its option, maintain automated back-ups of data on shared hosting servers. These backups are for Dragon's convenience and internal use. Customer should not rely on their existance, availability, timeliness or completeness. Such backups, if made, will be created during normal operations and may exclude files and databases that are locked, in use, or otherwise made unavailable by the operating system or other factors. Dragon shall have no liability to customer in the event all data is lost or destroyed. Customer acknowledges and agrees that in the event restoration of data from backup is necessary (and possible), it may take several days to complete such restoration of data and resume operation of the service. Customer acknowleges and agrees that restorations attempted from such internal backups may not be complete or error free. Dragon reserves the right to suspend or terminate such backups without notice, included but not limited to server operation and performance requirements.

Standard support fees will apply to backups restored due Customer errors or negligence.

Customers are solely responsible for backups on unmanaged dedicated servers and co-located equipment.
